Welcome to Yebtah. Please read these terms and conditions carefully. By accessing or using our platform, you accept and agree to be bound by these terms. If you do not agree, please refrain from using our services.

Yebtah is a real estate platform that connects property buyers, sellers, and renters in Kuwait. We do not provide any warranty on properties advertised on the platform, including the accuracy of listings, property conditions, or transaction outcomes. Furthermore, Yebtah is not liable for any claims of compensation for any losses arising from property transactions.

These Terms and Conditions are governed by the laws of Kuwait, including but not limited to Kuwait's Electronic Transactions Law (Law No. 20 of 2014), Personal Data Protection Law (Law No. 42 of 2023), Consumer Protection Law (Law No. 39 of 2014), and Communication Labor Law (No. 63 of 2015).

1. Property Listing Rules

• Users must register with a verified phone number to post listings
• Property listings must be accurately categorized (sale/rent)
• All listing details including price, location, and specifications must be accurate
• Only the property owner or authorized agent may post listings
• Each listing must be for a single property - multiple properties require separate listings
• Images must be recent and accurately represent the property
• Listings violating Kuwait real estate laws will be removed
• Property listings must not contain any illegal, immoral, or obscene language or images, or misleading information
• Advertisers may only advertise for one property per listing

2. User Responsibilities

• Users must be at least 21 years old
• Users must provide accurate contact information
• Users must respect other users and maintain professional communication
• Users are responsible for verifying property information before transactions
• Users must comply with Kuwait's real estate and cyber laws
• Users must not engage in discriminatory practices or harassment
• Users are responsible for any legal liabilities arising from their listings or actions on the platform
• Users must secure all required permits and documentation required by Kuwait law for real estate transactions

3. Prohibited Content

• Real estate listings from individuals or entities without proper authorization to sell or rent the property
• Property listings without verified contact information
• Misleading property descriptions, fake listings, or fraudulent real estate advertisements
• Advertisers must obtain all required permits and approvals from official Kuwaiti authorities before posting advertisements for regulated real estate activities. Documentation confirming authorization must be provided to Yebtah upon request
• Advertisements of properties that violate Kuwait's real estate laws

4. Privacy and Data Protection

• User data is protected and only shared as permitted by Kuwait's Personal Data Protection Law (Law No. 42 of 2023)
• We cooperate with Kuwait authorities regarding illegal activities
• Users must maintain access to their registered phone number for account security
• We may share user data with authorities if required by law
• The user agrees to provide contact information to authorities through Yebtah in cases of legal violations such as fraud or misrepresentation
• Yebtah may report violations of Kuwait law to the appropriate authorities, including the Kuwait Electronic Crimes Control Department

5. Listing Management

• Listings will be active for 30 days, after which they will be automatically removed
• Non-compliant listings will be removed without notice
• Users may be blocked for repeated violations
• Yebtah reserves the right to modify or remove any content
• Any property listing suspected of being fake, inaccurate, or misleading will be removed without prior notice to ensure marketplace integrity

6. Intellectual Property

• Yebtah holds ownership over all intellectual property rights and platform contents, including data, images, and content in all forms available on the platform
• The platform's content, including property listings, images, and descriptions, may not be copied, scraped, or used on other websites or services without explicit written permission from Yebtah
• It is prohibited to reverse engineer or disassemble any part of the application
• Yebtah will take appropriate legal action against any person or entity infringing on or violating the intellectual property rights of the platform

7. Legal Compliance

• Users must comply with Kuwait real estate laws
• Property transactions must follow legal procedures
• Users are responsible for obtaining necessary permits
• Disputes will be resolved under Kuwait law
• Users bear full legal responsibility for their listings and actions
• Placing ads for competitors is prohibited
• Any advertisement in violation of Kuwait law may be removed without notice

8. Virtual Tours

• Virtual tours will remain active until the property is sold or rented, or for a maximum period of six (6) months from the date of creation, whichever occurs first
• After the six-month period, property owners must pay a renewal fee to continue offering the virtual tour
• Virtual tours created through our platform remain the intellectual property of Yebtah
• Property owners grant Yebtah permission to create, host, and display virtual tours of their properties
• Users are prohibited from copying, downloading, or redistributing virtual tour content
• Property owners are responsible for ensuring the property is accurately represented in the virtual tour
• Yebtah reserves the right to remove virtual tours that misrepresent the property
• Virtual tours that violate Kuwaiti law or platform policies will be removed immediately
• Yebtah reserves the right to modify the virtual tour pricing structure and renewal fees at any time

9. Payments and Financial Terms

• Yebtah may charge fees for premium and promotional services, including Featured listing promotions and virtual tour services
• Promotional purchases (including Featured listings) are charged in US Dollars (USD); a Kuwaiti Dinar (KWD) amount may be shown for reference only
• All promotional purchases, including Featured listings, are final and non-refundable
• Refunds may only be issued in the case of a technical failure on Yebtah's part that prevented the purchased service from being delivered
• A Featured promotion increases a listing's visibility for the stated duration; we do not guarantee any specific number of views, leads, or outcomes
• Virtual tour renewal fees will be clearly communicated to users prior to the expiration of the initial period
• Any purchased credit will be valid for 1 year from the purchase date

10. Dispute Resolution

Any disputes arising from the use of our platform or these Terms and Conditions shall be governed exclusively by the laws of Kuwait. The courts of Kuwait shall have exclusive jurisdiction over any legal proceedings related to these Terms and Conditions or your use of the Yebtah platform. Before initiating legal proceedings, users agree to attempt to resolve any disputes through direct communication with Yebtah customer service.

11. Modifications to Terms

Yebtah has the right to modify these terms and conditions at any time without prior notification. These modifications will be effective immediately upon being posted on the platform. It is your responsibility to review these terms and conditions carefully and regularly to stay informed of any modifications. Continuing to use this platform after modifications to the terms and conditions constitutes an expressed approval of these changes.
